Terms and Conditions For Additional Private Studio Lessons

 

This agreement is between Sam White (Owner of Drum Unlimited and Teacher) and the Student or Parent/Guardian of the student, should student be under 18 years of age. for the Teacher to provide Additional Lessons ("Additional Lessons") on the drum kit to the student, to commence on­­ the agreed date and time and location as booked through the website booking services or directly through the teacher. Each Lesson to have a duration of 30/45/60 minutes.

The current studio lesson fees are: -

£22 per 30 minutes,

£33 per 45 minutes,

£44 per 60 minutes

Skype Lesson Fee's

£18 per 30 minutes,

£27 per 45 minutes,

£36 per 60 minutes

which is payable in advance of the lesson date and time no later than 48 hours before the start of the booked lesson. If payment is not made in time then the student may not be able to take the lesson whilst still being liable for the payment.

  • This Additional lesson will NOT be taken from existing pre-paid lessons, unless agreed in writing by the teacher.

  • Payment Information:- Payment is to be made no later than 48hours before the start of the additional lesson.

  • Additional lessons are subject to the same TWO WEEKS notice for cancellations. The student/parent/guardian understands that any additional lessons booked with fewer than the two weeks before the additional lesson start date, will not be able to be cancelled or rescheduled, nor the payment carried forward. Please be certain that you will be able to make the days and times of any additional lessons that you have booked.

  • Additional lessons are intended for students who may sometimes require extra help in the run up to an exam, performance, audition or similar and ARE NOT intended to replace any forfeited lessons or act as a rescheduling service for any cancelled lessons that are cancelled with fewer than the required two weeks notice.

  • If you are owed, or believe you are owed a rescheduled lesson, then please check the calendar and contact the teacher directly. Please allow enough time for the teacher to book the extra studio time. Should the studio be unavailable then the student will be offered a different time-slot or a refund.

  • Additional lessons are only offered to those who have an existing studio/school contract. Any lessons from students that DO NOT have an existing agreement will be cancelled immediately. If you would like to become a student then please contact Sam@drumunlimited.co.uk

 

The studio lessons will take place at: Studio 10, Mill Hill Music Complex, 1 Bunns Lane Works, Bunns Lane, Mill Hill, London, NW7 2AJ.

Skype Lessons will take place at the agreed time.

Private teaching

 

1. Fees

Lesson fees are subject to annual review. Where Lesson fees are increased as a result of such a review, the Teacher shall endeavour to give the Student at least one month's notice of such increase. The Student shall have the right to terminate this agreement immediately on written notice to the Teacher without liability to pay for any further Lessons (and to receive a refund in respect of any Lessons for which the Student has paid in advance) in the event that the applicable Lesson fees increase. Occasionally fee's may be offered at a discount, such as during holiday periods. In this instance, the lesson fee's will be as advertised and will only be available for the stated period time on the promotional material. Outside of these dates, the lesson fee's will be as stated above.

 

2. Missed Lessons

Any Lesson missed by the Student shall be paid for unless otherwise agreed with the Teacher. If the Teacher is unavailable to give any scheduled Lesson, the Lesson will be carried forward to another date. If this is not possible, any fee already paid will be refunded or used to pay for a future Lesson.

3. Additional Lessons

Extra Lessons may be scheduled at any other time by mutual agreement and at a cost mutually agreed between the Student and the Teacher. Additional drum lessons are not entitled to the same cooling off period as they are only booked by students who have an existing agreement where the 14 day cooling off period has already expired.

In the rare instance the additional lessons fall within the 14 day cooling off period of the main studio agreement's start date, then the rules of the cooling off period will apply as stated in the main studio agreement. In this rare circumstance, lessons cancelled with fewer than 72 hours notice will be still be liable to pay the studio costs.

 

Studio costs are:-

30 minutes £4

45 minutes £6

60 minutes £8

4. Cooling-off Period

a) The Student has a legal right to cancel the original studio agreement under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the "cooling off period" set out in 4(b) below. This means that during that cooling off period. if the Student changes his/her mind or decides for any other reason that he/she does not want to receive the Lessons. the Student can notify the Teacher of his/her decision to cancel the agreement and receive a refund for any Lessons paid for but not received prior to that cancellation. (See 3. Additional Lessons)

b) The Student's cooling off period starts from the date of the main studio agreement and ends 14 days later. To cancel the agreement the Student should let the Teacher know that he/she has decided to cancel in a clear statement.

5. Limitation of Liability

a) If the Teacher fails to comply with the terms of

this or the original studio agreement. He is responsible for loss or damage the Student suffers that is a foreseeable result of the Teacher's breach or his negligence, but is not responsible for any loss or damage that is not foreseeable.

b) If the Lessons are due to be performed at the Student's home, the Teacher is responsible for any damage caused by him to that property.

c) The Teacher does not in any way exclude or limit his liability for death or personal injury caused by its negligence. fraud, or fraudulent misrepresentation.

6.Goods

From time to time, the Student may request that the Teacher:

a) Supplies them with goods (for example, sheet music, strings or reeds): or

b) Loans them an instrument or other equipment. in connection with the provision of the Lessons or the undertaking of performances and/or examinations. This agreement is not intended to include provisions applicable to those scenarios, and the Student and the Teacher should mutually agree relevant terms in writing as required.

7. Termination of Agreement

A decision to discontinue Lessons after the cooling off period may be taken by the Student or the Teacher in which case written notice, the period of which is stated overleaf, shall be given by the party seeking to discontinue. In the event that the Student discontinues Lessons with insufficient notice, the Student will be liable to pay fees for those Lessons not taken during the notice period.

 

8. General

a) Neither party shall be liable to the other party for any breach by the other of any of the terms and conditions herein occasioned by any act of God, war, revolution, riot, civil disturbance, strike, lock-out. flood, fire or other cause not reasonably within the control of such party.

b) The Student undertakes not to make copies of any sheet music from either grade books or any published materials. The student has permission to make use of the lesson materials, PDF's, lesson plans and videos owned by Sam White or Drum Unlimited and understands that sharing said resources with any third party is strictly forbidden. Any student found to be doing this could have their members account suspended or even deleted and their contract cancelled immediately.

c) Examination entries, festivals, competitions or otherwise will only be entered if the Student and Teacher are in agreement. Any entry fees will be paid for by the Student.

d) The Student is responsible for the insurance of the Student's instrument.

e) In the interests of the Student's well-being whilst in the Teacher's care, the Teacher must be informed of any medical or other condition affecting the Student.

f) If the Student is under eighteen, the Student's parent or guardian gives permission for the Teacher to teach the Student.

g) The Teacher is a member of the MU and agrees to abide by the MU's Code of Conduct. a copy of which can be obtained from the MU, whose address is 60-62 Clapham Road, London SWG OJJ.

 

 

NOTES FOR GUIDANCE

- "Term" in the above context corresponds to the termly calendar in Local Authority (LA) schools.

 

- MU members are insured personally in respect of legal liability that may arise following injury or damage to members of the public. The limit of indemnity is £10m. This policy is only operative whilst the individual registered member is performing, rehearsing or auditioning either solo or as part of a group, band or orchestra and/or whilst teaching either at the member's

own home, the Student's own home, or in a public place including transit to and from.

 

- It is important to note that whilst a Teacher will use his or her best endeavours to ensure the Student makes satisfactory progress. this cannot be guaranteed. In particular, careful regular practice as advised by the Teacher is a prerequisite of success on any musical instrument or in any musical endeavour.
